General Terms and Conditions

Legal Notice Tuning chips are installed or OBD-modified by motor-tuner.at only under the following conditions:

Option A: The vehicle is not used on public roads but exclusively for motorsport purposes.
Option B: Any performance change outside the tolerance range must be officially registered (typed) by the vehicle owner. Otherwise the vehicle registration and insurance coverage will be invalidated. Costs for technical inspection reports can be provided upon request.

1. Definition

These T&Cs form the basis for business relationships between Motor-Tuner.at Gerhard Breithuber e. U. and the contractual partner – for both businesses (§ 11 HGB) and consumers.

2. Scope

Deliveries, services and offers between Motor-Tuner.at and the customer are made exclusively on the basis of these conditions. By accepting them, the customer agrees and is obliged, when reselling, to pass these T&Cs on to third parties.

3. Offer, Contract Formation and Withdrawal

Our offers are non-binding. The customer is bound by orders for two weeks. Withdrawal requires written confirmation by Motor-Tuner.at.

4. Delivery and Performance

All delivery dates are non-binding unless a fixed date has been agreed. Force majeure releases Motor-Tuner.at from the delivery obligation. The customer is not entitled to compensation for non-delivery.

5. Prices

The prices of the most recently issued price list or agreed arrangements apply, plus statutory VAT on the day of delivery/service.

6. Product

All statements regarding performance, consumption and speed are guideline values that may deviate slightly. Liability is excluded thereby. By accepting the vehicle, the customer agrees to the work performed.

7. Warranty

From the time of installation it is noted that performance changes may invalidate the manufacturer's warranty. Motor-Tuner.at therefore offers the option of an additional warranty insurance. Further claims, in particular consequential damage, loss of use or hire car costs, are excluded to the extent permitted by law.

7.1 Warranty for Software Customers

Motor-tuner.at accepts no warranty or guarantee for the vehicle in which the tuning software is installed. This responsibility lies with the dealer or tuner who performed the installation.

8. Retention of Title

The delivered goods remain the property of Motor-Tuner.at until full payment has been received.

9. Payment Terms

Immediately upon receipt of the invoice, without deduction.

10. Copyright

All products delivered by Motor-Tuner.at (software, hardware, corporate design) may not be copied or imitated. Violations will trigger a contractual penalty of EUR 25,000.

11. Place of Jurisdiction

Place of jurisdiction is Wolfsberg.

12. Severability Clause

Should individual provisions of these T&Cs be invalid, the validity of the remaining provisions shall remain unaffected. The parties undertake to agree on an economically equivalent replacement provision.
